Preliminary considerations

CHEMIFARM SRL has its registered office in Via E.T. Moneta (Q.re SPIP) No. 15/A, 43122 - Parma - Italy, REA 156145, VAT number 00952860344, Cap. Soc. 100.000,00 € fully paid.

The e-commerce sale of CHEMIFARM products is governed by the general conditions expressed here. When you order products through the website and tick the box " I declare that I have read and accept the Privacy Policy and Conditions" and then you submit your order these conditions will be deemed accepted.
If you are placing an order on behalf of a company or organization, you confirm that:

1. the company or organization accepts these Conditions; and
2. you are authorized to place the order and accept these Conditions on its behalf.

1. Field of application

CHEMIFARM SRL markets its products exclusively to natural or legal persons operating in the context of an entrepreneurial or professional activity (B2B).

2. Responsibility of the user

The CUSTOMER is solely responsible for the choice of the product and its use. CHEMIFARM SRL is neither responsible nor guarantees that the product is suitable for the technical applications identified by the CUSTOMER at the time of its purchase. All the products we supply are exclusively made to be used by suitably qualified personnel, as users are solely responsible for their handling and use. It is also CUSTOMER’s responsibility to comply with the applicable legislation and, in particular, the provisions relating to occupational safety, hygiene and accident prevention.

3. Description of products

The photographs and illustrations shown on the CHEMIFARM SRL website are indicative and may be modified. Product specifications indicate that the products comply with specific standards or requirements as they cannot guarantee compliance with other standards not expressly indicated.

4. Prices

The prices shown on our website do not include VAT or excise duties and are generally valid throughout the current year. We reserve the right to change any price without notice in case of significant changes in the cost price or in the event of errors. Prices include the standard packaging that CHEMIFARM SRL deems suitable for the transport of the purchased products. Shipping prices are calculated by steps according to the total weight of the products inserted in the "cart" and to the geographical area of shipment and are displayed in the order before the confirmation and payment by the CUSTOMER.
There is no minimum amount for the acceptance of the order.

5. Payments

Payments shall be made in advance by credit card. Other electronic systems may be made available on the website.

6. Orders and delivery terms

An order is considered accepted only when CHEMIFARM SRL sends, by email to the address provided during registration to the site, the "Order Confirmation". In case of available product this will be given to the courier within 2 working days from sending the "Order Confirmation". In case of unavailable product this will be produced and given to the courier within 5 working days from sending the "Order Confirmation". These generic delivery commitments do not constitute a binding contract allowing claims for damages in the event of non-compliance. If the delivery of a product is impossible for any reason, CHEMIFARM SRL reserves the right to cancel the pending order, to refund the CUSTOMER the purchase price and to be released from the obligation to deliver the goods, since the CUSTOMER cannot claim any compensation for damages.

7. Shipments

All shipments are carried out every day by express courier (Mail Boxes etc.). From the time of shipment CHEMIFARM SRL should no longer be held responsible for any delays in delivery, being they are attributable only to the work of the courier. Shipments shall be subject to the conditions of service laid down by the transport undertaking. In the order form, in the shipping data, there is a field where you can enter any information for the delivery of the goods. When the goods are given to the courier, the CUSTOMER receives a notification email with the tracking number.

8. Complaints and returns

The complaints concerning quantity, quality vices and defects or non-conformities shall be notified by email (address: info@chemifarm.it) under penalty of loss of right, at the latest within 8 days from the receipt of the goods. CHEMIFARM SRL will handle the complaint according to its relevant internal procedures and will update, by email, the CUSTOMER regarding the receipt and progress of the processing of the complaint. The product should be in its original packaging and the bottles or phials should not have been opened. After opening, refunds shall only be accepted if there are justified differences between the specifications published in the website and/or product labels and the actual specifications of the product. When the complaint proves to be unfounded, the CUSTOMER will compensate CHEMIFARM SRL for all costs incurred during the investigation and management of the complaint.

9. Warranty

CHEMIFARM SRL guarantees the conformity of the products supplied to the characteristics stated on the official website. The warranty period is strictly limited to the only defects attributable to CHEMIFARM SRL and shall be twelve months from delivery; it is subject to the regular complaint made by the CUSTOMER (see preceding paragraph). Pursuant to the above request, CHEMIFARM SRL may, at its choice and alternatively:

1. supply free of charge ex works to the buyer products of the same kind and quantity of those results defective;
2. provide in written statement the termination of the contract and refund the purchase price of the product and delivery costs incurred by the customer.

Except for fraud or gross negligence any compensation for the damage to the CUSTOMER shall not exceed the invoice price of the complained products. This warranty replaces the legal guarantees for defects and non-conformities and excludes any other ossible liability of CHEMIFARM SRL anyway originating from the products provided; in particular, the CUSTOMER shall not make any other claims for damages, price reduction or termination of the contract. After the warranty period no claim can be asserted against CHEMIFARM SRL which cannot be held responsible to the CUSTOMER for any loss of profit, disuse, non-production, loss of contracts or any other indirect or consequential damage.

10. Applicable law and legal venue

These conditions of sale are governed by Italian laws. Any dispute, of any nature, related to the supplies made by CHEMIFARM SRL are the exclusive competence of the Court of Parma.
